1. What Money Take Back does

Money Take Back provides tariff refund services for U.S. importers. We analyze your import documents, identify shipments eligible for IEEPA (International Emergency Economic Powers Act) tariff refunds, set up a CBP import portal account (known as ACE) on your behalf, prepare your refund filing, submit it to U.S. Customs and Border Protection, and monitor its status until your refund is deposited.

Customs filing services are provided by Noctifer LLC, operating as Money Take Back, in coordination with licensed customs professionals. Nothing in these terms constitutes legal advice specific to your situation.

By using our service, you authorize Noctifer LLC, operating as Money Take Back, to: (1) create and manage a CBP import portal account on your behalf; (2) enroll your account for electronic refunds; and (3) submit refund declarations through that account using the information derived from your uploaded documents. This authorization is granted when you complete the onboarding form and accept these terms.

2. Eligibility and authorization

You must be at least 18 years old and an authorized representative of the business entity on whose behalf you are using the service. By creating an account, you represent that you have authority to bind that business entity to these terms and to authorize us to create a CBP portal account and submit filings in its name.

3. Estimates are not guarantees

Refund estimates are based on the information you provide and the IEEPA tariff rate data we have on file at the time of analysis. The actual refund amount, if any, is determined solely by CBP. We make no representation or warranty as to whether any refund will be granted or in what amount.

If CBP denies or partially approves your refund claim, we will notify you by email with the reason provided by CBP, if available. Our service covers one filing per service order. Refiling or appeals are not included and would require a new service order.

4. Fees and payment

Service tiers are billed as a one-time flat fee at the time of purchase. Our fee covers the preparation and submission of your refund claim — it is not contingent on CBP approving the refund.

If we determine before beginning work that your shipments are ineligible for a refund, we will notify you and issue a full refund of the service fee. If we are unable to process your documents due to unreadable files or missing required information, we will contact you to resolve the issue; if it cannot be resolved, we will refund your fee. If CBP reviews and denies your claim after we have prepared and submitted the filing, our service fee is not refunded, as the work has been completed.

5. Your account

You are responsible for keeping your account credentials secure and for any activity under your account. You agree to provide accurate information when registering and to keep that information current.

6. Document handling

Documents you upload are encrypted in transit and at rest. We retain documents and extracted data for as long as needed to deliver the service and for a reasonable period afterward to support follow-up questions. Note: U.S. Customs regulations generally require importers to retain entry records for five years. If you request early deletion, we will inform you of any applicable retention requirements before completing the deletion.

7. Acceptable use

You may not use Money Take Back to upload documents you do not have the right to process, to submit fraudulent information to CBP, or for any illegal purpose. We may suspend accounts that violate these terms.

8. Disclaimer of warranties

Money Take Back is provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising from or related to this service is limited to the service fee you paid for the specific filing at issue. We are not liable for any indirect, incidental, or consequential damages, including any lost refund amount you believe you were entitled to receive from CBP.

10. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service will be resolved in the courts of Texas.
